The Legacy of 'EL TRI': Álex Lora Defends His Brand Against the Mexican National Team

After several years of legal battle, renowned Spanish rock singer Álex Lora has finally won the lawsuit for exclusive use of the trademark 'EL TRI'. This case has captured public attention due to its impact on the Mexican National Football Team and the well-known rock band that shares the same name.

The dispute originated in 2014 when Álex Lora decided to request the cessation of using the name 'EL TRI' to refer to the Mexican National Football Team. His argument was based on the fact that he had registered the trademark with the Mexican Institute of Industrial Property (IMPI) long before the Mexican Football Federation began to be referred to in the same way.

The name 'EL TRI' is inseparable from the figure of Álex Lora and his iconic rock band. Founded in 1968, 'El Tri' has become an institution in Mexican and Latin American music, influencing generations of fans with its distinctive style and impactful lyrics. Álex Lora registered the trademark 'EL TRI' many years ago, long before the Federation attempted to use it.

Now, Article 386 of the Federal Law of Industrial Property stipulates that using a registered trademark without the consent of the owner or without the corresponding license constitutes an infringement and is subject to administrative sanctions. In this case, the Mexican Football Federation argued that "EL TRI" was a nickname created by fans in reference to the Mexican National Team due to the colors of its uniform, and not a designation that the team had attributed to itself. According to the Federation, this exempted them from any intellectual property infringement.

However, the outcome of the litigation established that the Mexican Football Federation cannot use the nickname "EL TRI" to refer to the Mexican National Team. It is important to note that, to date, there has been no formal announcement from any authority related to the Mexican National Team regarding this situation.
