A Non-Consensual Kiss, an Eclipse Over the World Cup

The world of sports is characterized by moments of excitement, passion, and joy, but also by situations that can generate controversy. One of those moments that has sparked debate in recent days was the kiss that Luis Rubiales, president of the Royal Spanish Football Federation (RFEF), gave to Jenni Hermoso, a player of the Spanish women's national football team, during the Women's World Cup final. Consent is a fundamental principle in all human interactions, and sports are no exception. The footballer clarified publicly that the act carried out by Rubiales was not consented to at any moment. Without clear and express consent, any such action is inappropriate and a violation of personal integrity, potentially constituting behavior akin to sexual harassment.

The International Football Federation (FIFA), through its Disciplinary Committee, has decided to "provisionally suspend" Rubiales "from all football-related activities at national and international levels" due to his unacceptable behavior.

Jenni Hermoso filed a sexual assault complaint on Tuesday with the Attorney General's Office (in Spain) regarding Rubiales' non-consensual kiss. Hermoso's formal complaint is crucial to initiate proceedings, as Article 191.1 of the Spanish Penal Code mandates that for actions related to assault, harassment, or sexual abuse, a "complaint from the aggrieved person, their legal representative, or a criminal complaint from the Public Prosecutor's Office" is required.

Now, since the final was held in Sydney, Australia, Article 23.2 of the Organic Law of the Judiciary in Spain establishes a series of requirements for Spanish jurisdiction to investigate crimes allegedly committed abroad if the alleged perpetrators are Spanish nationals, as well as the victim. Therefore, we must be attentive to how authorities handle the follow-up regarding this unfortunate incident. Athletes, both men and women, are professionals who deserve respect and consideration in their workplace. When has a coach been seen kissing their male players in men's football? Jenni Hermoso said in a press interview, "I felt vulnerable and like a victim of an assault."

It's regrettable that the great triumph of winning a World Cup hasn't been properly celebrated. All the positive achievements of the players in the World Cup, which not only elevated the Spanish nation but also women in the sports world, have been overshadowed. Once again, women see their successes overshadowed by gender-based violence.
